Mike Lynch, the founder of the software group Autonomy, was a \u201ccontrolling and demanding individual\u201d of whom it was inconceivable that he was unaware of the fraudulent practices alleged to have been taking place at his company, the high court has heard.<\/p>\n

The claims are included in the opening submissions of a\u00a0civil claim<\/a>\u00a0brought by Hewlett Packard against Lynch following the\u00a0\u00a38bn sale<\/a>\u00a0of his company to the US firm in 2011.<\/span><\/p>\n

Court documents submitted by HP said Lynch took an interest in trivial details of his firm\u2019s operations to a level that was \u201chard to imagine \u2026 coming to the attention of the CEO of any other large company\u201d, including approving a \u00a32,659 upgrade to a graphic designer\u2019s computer.<\/p>\n

They claim he exerted control over Autonomy\u2019s chief finance officer, Sushovan Hussain, who is a co-defendant in the civil claim and who is appealing against a conviction in California in a related case, to the point that he would make threats when she tried to take leave.<\/p>\n

In one email, referred to in the claimant\u2019s opening submissions, Lynch wrote to Hussain: \u201cThank you for your threat to take five weeks off between now and the [year end]. Please do that and you will see the consequences \u2026 Sushovan I am sick of dealing with this shit from people … do what the fuck you like.\u201d<\/p>\n

This type of email was typical of Lynch, the claimants alleged, who \u201ccreated an oppressive work environment in which employees felt \u2018extreme pressure\u2019 to meet revenue goals\u201d.<\/p>\n

In an email on 29 July 2009 Lynch demanded a sales representative \u201cstay up all night and get this done with your team, ring whom ever you need but we are putting in the maximum proposal on time \u2026 Fail this and I have no need of people with this kind of attitude\u201d.<\/p>\n

The defence for Lynch and Shushovan, who are being jointly defended, has said Autonomy\u2019s finances were audited by Deloitte and that the business took a downturn after it was acquired because of mismanagement by HP.<\/p>\n

A spokesperson for Mike Lynch said: \u201cMike Lynch is pleased to finally have the opportunity to respond in court to HP\u2019s accusations.<\/p>\n

\u201cThere was no fraud at Autonomy. Rather, this is a case that distils down to a dispute over differences between UK and US accounting systems and will focus on the appropriate exercise of business judgments made in a particular context and time with the full knowledge and approval of numerous financial and technical experts and advisers.<\/p>\n

\u201cThe real story is that HP, after a history of failed acquisitions, botched the purchase of Autonomy and destroyed the company, seeking to blame others. Mike will not be a scapegoat for their failures.\u201d<\/p>\n
